Use this form to ask candidates about spent and unspent convictions only if they're going to work in a role that is exempt from the Rehabilitation of Offenders Act 1974.  This document has been updated in light of section 193 of the Police, Crime, Sentencing and Courts Act 2022 to reflect changes to the rehabilitation periods table that came into effect on 28 October 2023.

• If the candidate isn't going to work in a role that is exempt, use our registration form - that only asks about unspent convictions. 
• No candidate is required to disclose protected offences. 
• Use our criminal records legal guide and DBS legal guide to determine if you can ask a candidate about both spent and unspent convictions.
• Only process information that is necessary - to comply with data protection legislation.
